Definition

A licensed professional engineering role in which an engineer, having completed a forensic investigation and submitted a written report to a retaining attorney during active litigation or settlement proceedings, subsequently discovers that the data underlying the report's conclusions was inaccurate, bearing obligations to promptly notify the retaining attorney of the error, correct the report, and ensure that inaccurate conclusions are not used to the detriment of any party or the integrity of the legal process — even when disclosure may be adverse to the retaining client's litigation position.
