Definition
Duty of a licensed professional engineer — and of professional engineering organizations such as NSPE — to recognize that antitrust and First Amendment rulings have removed or constrained ethics code provisions governing professional selection, compensation, competitive bidding, advertising, and related practices, and that this constraint does not diminish the force of applicable federal, state, and local procurement laws; accordingly, engineers must comply with those procurement laws as a matter of legal and ethical obligation even where the ethics code itself cannot directly prescribe conduct in those areas.
