Definition
State in which the ethical weight of a confidentiality obligation is materially affected by the manner in which safety-relevant information came to the engineer's attention: information discovered independently through professional inspection carries a weaker confidentiality expectation than information directly and voluntarily disclosed by the client in confidence — such that the source of the information (inspection vs. client disclosure) determines the strength of the confidentiality countervailing duty and the scope of the engineer's reporting obligation.
